Before acceptance of a commission, you need to have read, understood and accept all the following terms and conditions.

It is my choice whether I accept a commission or not.

Before commissioning your pets portrait there will be a discussion process on the size of the portrait, how many subjects, background, media, price, when I can schedule to do your pets portrait, how long it will take, if it is an oil painting a rough idea how long it will take to dry, and anything else that is important. All of this will be sent to you in writing. When we are both in agreement of this the 50% deposit will be taken.

No contract will exist until the deposit has been received by myself. After that the contract will be governed by British Law.

All deposits are non refundable after 7 days of commissioning the work.

If you wish to cancel the contract to commission your pets portrait, then notice must be given in writing.

There is a 7 day cooling off period after a portrait is commissioned. If you cancel the contract of your pet portrait during the first 7 days, and no work has been done on the piece of work during those 7 days, full refund of the deposit will be given.

Upon accepting the commission and the 50% deposit, you are giving me permission to use your photograph as source material for the purpose of making either an oil painting or a graphite drawing.

Photographs. It is preferred that a digital photograph is sent by email. This can be a photograph taken by a digital camera or smartphone, or a scan of an old photograph.

If you are unable to send a digital photograph, and can only send a physical photo by post, I cannot guarantee the safety of your property or be held liable in any way. I would highly recommend not to send your only copy to me. I will say again digital photographs sent by email are far better. All physical photographs will be returned with the finished piece of work.

Third party source material. If you provide source material from a third party then it is your responsibility to provide all necessary permission to use it to produce your pet portrait. This might mean getting written permission from the copyright holder.

All photographs are presumed by myself to come with full permission, and no responsibility will be taken if this is not the case.

The pet portrait remains my property until final payment has been payed.
Only after receipt of final payment will your pets portrait be sent by recorded delivery.

Any photograph that you send me I have no copyright over.

Occasionally I will put on my website or social media a copy of the photograph that was used as the reference for your pets portrait. Before I do this I will request written permission from you to do so. Only after receiving written permission from you will I do this.

Under British Law I have, as an artist, something called artistic copyright. Even after full payment and you have received your pets portrait I still retain the full copyright.

I will never produce prints of your pet to sell, nor will I reproduce it on any other things to sell, eg mugs, calender’s, etc. But this enables me to put images of your pets portrait on my website, social media, part of my portfolio or to advertise my work. This is mostly to show others what I have done and therefore what I could potentially do for them. If you prefer me NOT to use your pets portraits, then you must inform me prior to the final payment in writing your wishes. I will gladly comply and respect all your wishes.

I will not put any images of your pets portrait on my website, social media or in my portfolio until 2 weeks after receiving final payment. If your pets portrait is a gift to be given on a particular day, then you must inform me of the date in writing before the final payment. I will then not show any images of your pets portrait on either my website, social media or in my portfolio until 1 week after the specified date.

If you wish to reproduce your pets portrait, eg as a Christmas card, etc, I would be very happy for you to do this. If you intend to gain financially from your pets portrait THEN YOU MUST CONTACT ME and get written permission.

Your details will be kept securely on a computer by self and by PayPal on their system. They will never be disclosed to anyone else. Your details can be deleted at any time by contacting me, as long as it does not interfere with the completion of the commissions. After you have received your pets portrait I will contact you to see what you think of it. After this your details will be deleted unless you want me to keep in touch with you and give you updates on what I am doing.
